In the humor section or maybe since it seems pertanent to the automotive industy as a whole I though maybe common faults!

Not to say there are not decent businesses out there but it seems bullshit for money is common particalarly were cars are concerns!

Ralph.
I rather get the feeling that any of about ten people could seek damages from the creator of the web site, and that if he happens to be "judgement proof" they will come looking for anybody who aids in its publicity.

I'd suggest that the thread gets pulled before this happens to either Aussie Frogs or the original poster in this thread.

Cheers

Rod,

How do you figure a forum like this (or the poster)could be sued?
Im not a lawyer but surely this thread was posted without opinions, and everyone can make their own mind on the legitemacy of the website.

I just hope we dont get to the situation when we are afraid of free speech espacially on the subject that could affect most of the members and/or visitors to the forum.

cheers,
tekkie

What is it with this "I'll sue you" crap whenever somebody tells a story about someone?
If the company concerned is confident enough in their reputation & standard of business, what do they have to gain by "sueing" anybody apart from giving themselves some bad publicity.
We had a red neck Premier in this State, Queensland, who was always threatening to sue somebody; they were commonly known as "stopper writs" a way to shut people up. His mate Russ Hinze used them regularly too. I knew a guy when I lived down the Gold Coast who took Hinzey on & decided to defend one & told Hinze it would be the end of his political career if he followed it through, and he was right. 1 am the morning of the case, Hinze settled out of court by correcting exactly what this guy had accused Hinze of. deal deal
I have just been quoted in the Courier Mail as telling the UN & that Hagan, the Aboriginal activist who is trying to make a name for himself in Toowoomba by changing the name of the "Nigger" Brown stand as creating racial problems & told them both to get stuffed. Pity more didn't do the same. Basically when somebody says "I'll sue you" it's an admission that they have something to hide and they do themselves more harm by taking that action than by keeping quiet.
If Pedders are whiter than white, they do not have a thing to worry about. If they find it offensive, then ask why.

Too right ... seems like the Pedders debate is on more then one forum like Explore Oz , with supporters and knockers - not being able to "knock" something is just un-Australian. Telling BIG porkies on the other hand ... mmmmm.

I think this ex-franchisee (get the drift his name is Ralph Penistan (how's that for irony ) would have gained more support if he'd stuck to the facts and refrained from some of the personal attacks and obscenities. If Pedders did screw him out of $350,000 I think we'd all want to know of any dodgy dealings.

XTC206

PS: It's not just Pedders, a very well regarded Shop was fixing a friends MX5 (was hit by a 4WD who drove off - police can't find the [email protected] ) - upon return there was over 20 things wrong/unfinished or not finished up to scratch - the insurance assessor came out and agreed it wasn't good enough - and back it went. deal Including, paint wrong colour, paint over runs, paint overspray, visible chips, destroyed seals, badly aligned panels, forgotten certain bolts and other things. I'm sure you all have similar horror stories.
You're not fooling everyone, or did you forget? .......

Hey, guys, I'm not a lawyer either, and I'm all in favour of free speech, but the web site referred to itself is clearly highly defamatory of a number of individuals as well as the company concerned and by explictly publishing links to it, Aussie Frogs (or the poster) could be seen to be jointly a "publisher". Remember in Australia people can take action based on the toughest defamation laws and that "truth" alone is not a defence in some jurisdictions.

Defamation cases involving the net are becoming a big deal these days and the recent Gutnick case points to some of the vulnerabilities.

If you want a good general guide take a look at http://www.efa.org.au/Issues/Censor/defamation.html
